THESE TERMS & CONDITIONS, TOGETHER WITH YOUR ORDER AND ORDER CONFIRMATION, COMPRISE THE ENTIRE AGREEMENT FOR THE PURCHASE BETWEEN JULIE JOSEPHINE AND THE CUSTOMER.

SALE OF MERCHANDISE

We ask that you please read these Terms & Conditions before placing an order on juliejosephine.com, and that you do not place any orders unless you understand and agree to the Terms & Conditions. When a Customer places a purchase order the Customer agrees and consents to these Terms & Conditions.

Please note that the Terms & Conditions may be amended or modified from time to time by us without notice at our sole discretion.

PRE-AUTHORIZATION OF CREDIT AND DEBIT CARDS

Please note, when paying for an order with a credit or debit card, we will pre-authorize your card for the portion of your order that is delivery expenses, along with applicable freight and sales tax, prior to processing your order. The full amount will then be charged to your card once your order ships. Pre-authorizations reserve the total sales amount on your credit card (or funds available through your debit card) to pay for your order. Pre-authorizations will drop off of your account within 1-7 days, depending on your card issuer.

SHIPPING

The Customer is responsible for all shipping and freight charges, unless other information is given. Orders received prior to 16.00, will ship the following business day, subject to availability. Orders received prior to 09.00 will ship the same day. Postnord will execute all orders made domestically. DHL will execute orders made internationally.

We strive to deliver products on or before the date for delivery set out in our order confirmation or, if no date is set out in our order confirmation, within 5 working days of the date of our order confirmation (except pre-orders). However, please note that we cannot guarantee delivery by the relevant date.

PRICES, STYLES AND COLORS

All prices on juliejosephine.com are subject to change without notice. All merchandise will be billed at the prices in effect at the time of ordering. We reserve the right, at our sole discretion, to at any time change or discontinue styles, colors, sizes or fabrics.

All orders are subject to availability from time to time. We reserve the right to cancel a sale of merchandise after a purchase order has been placed by the Customer in the event that such merchandise is not in store at the time of delivery of such merchandise.

All prices include VAT.

Note that we do not stand responsible for any extra VAT or duty costs outside of Norway. The customer is fully responsible to research all VAT and duty costs of their repective country before proceeding with an order.

NOTICE OF DEFECTS

The Customer is always responsible for inspecting the merchandise upon receipt. If the merchandise has defects or items are missing you may according to the circumstances require a re-delivery, a refund or that the agreement be cancelled. The defect must have existed when the products came into your possession. The Customer shall notify Julie Josephine in writing within 10 DAYS of the Customer’s receipt of the merchandise of any claims resulting from delivery or any defect in the merchandise discovered by the Customer. The claim can be made to shop@juliejosephine.com. (Please include your order reference number in the e-mail subject line).

We cannot accept claims or returns of merchandise, which has been altered, laundered, or modified in any manner. Unless directed otherwise by a customer representative of Julie Josephine, all damaged or incorrect items will need to be sent back to us to receive credit in respect of a purchase.

JURISDICTION AND GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted under the laws of Norway. If any provision of these Terms & Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms & Conditions, which shall remain in full force and effect.

The Customer expressly agrees that the exclusive jurisdiction for any dispute with Julie Josephine, or in any way relating to these Terms & Conditions, resides in Oslo district court (Oslo tingrett).

DISCLAIMER OF WARRANTIES

The merchandise may not have the exact function, size, color, construction etc. as they appear on this webpage. We can therefore not guarantee or warrant variances in color, shade, size, or construction of the merchandise. Julie Josephine hereby disclaims all express and implied warranties, including, without limitation, implied warranties of merchant-ability and fitness for particular purpose.

Julie Josephine reserves rights against errors which may arise and which may result in our inability to deliver in accordance with the information given at this website, in our marketing or in any other way. Julie Josephine reserves rights to withdraw products from the website and change the website and its contents.

LIMITATION OF LIABILITY

We will not be liable to you in respect of any losses arising out of any event or series of events beyond our reasonable control. The Customer acknowledges that Julie Josephine shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages including but, not limited to, damages for loss of profits, goodwill, or other intangible losses, or personal injuries resulting from use or sale of our merchandise.

Any statutory rights, which you have as a consumer, which cannot be excluded or limited, will not be affected by these Terms & Conditions.

All materials published on this website (including but not limited to articles, photographs, images, illustrations, audio clips and video clips) are protected by copyrights which are owned and controlled by us or the party credited as the provider of the material.
